Victoria's Secret - Officially Too Hot To Handle

The Consumer Product Safety Commission and Victoria's Secret Direct in Columbus, Ohio have issued a recall of about 500 silk kimono tops, manufactured by Single of Los Angeles, California. The 57 consumers who purchased the item have been instructed to stop using the product immediately.

The product was found to include a fabric that fails to meet the mandatory standards of fabric flammability, violating the federal Flammable Fabrics Act. The outer shell fabric of the top has proven readily flammable and dangerous to the consumer.

FDA Recall of Salt Solution

On February 13, 2006 the FDA requested a recall of all brands and sizes of Cytosol's Balanced Salt Solution (BSS). The drug has been used for years to irrigate a patient's eyes, ears, nose and/or throat during various surgical procedures, including cataract surgery. The recall is due to the discovery of elevated levels of endotoxin in the product, which can cause serious reactions such as shock, fever, and changes in blood pressure. Contaminants such as endotoxin have been known to cause irreversible eye conditions such as Toxic Anterior Segment Syndrome, in which an inflammatory reaction occurs in the anterior segment of the eye. The FDA has recieved over 300 injury complaints from patients who were given BSS. FDA instructs hospitals, physicians, and consumers to immediately stop using BSS, and to eliminate any existing stores of the drug.

If you or a loved one has been hurt by this or similar defective products, try consulting a personal injury lawyer.

Anesthesia Malpractice Gives Patient $1 Million

Mr. Lindsay Nahay of McCandless, Pennsylvania underwent knee surgery on Feb. 11, 1999. This was not a wholly new procedure for the 47 year old resident, and his procedures were usually done under a general anesthesia, but on that particular day his doctor used a nerve-blocking technique involving an injection into the sciatic nerve. The doctor failed to fully inform Mr. Nahay of the risks, complications, and alternatives to the type of anesthesia that was used on him. Had Mr. Nahay known these, he would surely have avoided taking the injection, as he was reluctant with the procedure as it was. He had every right to be relcutant - the surgery left him with constant pain and numbness in one foot, an unemployable condition. Luckily for Mr. Nahay, he had a good personal injury lawyer to help fight his cause, and recieved $150,000 for pain and suffering, $750,000 in past and future lost wages, and $160,000 for future medical bills and expenses. His wife Christine also recieved $40,000 for loss of consortium. Although Mr. Nahay still mourns his injury, he feels gratified due to the result of his case.

If you have been injured due to malpractice and wish to be gratified as Mr. Nahay of McCandless was, get yourself a good personal injury lawyer! Peter G. Angelos is a reliable personal injury attorney in the Philadelphia, Pennsylvania area.

FDA Urged to Ban Carbon Monoxide Exposed Meat

Carbon Monoxide is a colorless, odorless, and flavorless gas which is potentially dangerous when improper care is used in its handling. It is the same gas which was used by Hitler to exterminate the Jews. The meat industry has found a new use for this gas - to turn its flanks and steaks an attractive pink to sell to customers who are skeptical of many healthy meats' dirty brown color. Steaks turn brown because of air exposure, same as an apple would. The meat is still perfectly healthy and delicious, but no longer looks appetizing... so to keep business running better, some companies have been investing in carbon monoxide exposure to give them the same juicy "cherry red" appearance as the holocaust victims. The problem here isn't actually the exposure to the dangerous gas, but the fact that the meat exposed to it stays red long after being exposed - even when it is rotten far past its prime. The consumer's shallow decision might wind up costing them their health based on the meat industry's bad judgement.

Brenda L. Page Named "Advocate" from ATLA

Brenda L. Page is the principal of the law firm of Page and Associates Law Office, P.C. in Richmond, Virginia. She has been recently given the recognition of Advocate pursuant to the National College of Advocacy Achievement Recognition Program of the Association of Trial Lawyers of America (ATLA). This classification is due to Attorney Page's commitment to effectively represent her clients through her development of professionalism and dedication to education.

Brenda L. Page's firm represents those who have been injured as a result of negligence of others, including people injured or killed in car and tractor-trailer accidents, train accidents, airplane accidents, medical malpractice, dangerous prescription drugs, defective products, and intentional torts. Page and Associates also deals with criminal defense cases.

Attorney Page's personal history is a remarkable example of human accomplishment. She is a trial lawyer, serving in a plethera of jury trials throughout her career, with many impressive stories to tell. One such story is that of a young mother with four children, aged 6, 5, and two years, with one three-month-old infant. The mother had been killed in a tractor-trailer accident, leaving the children motherless and defenseless. The trucking company argued that the mother's life was not of great value, as she was unmarried, unemployed, and living in subsidized housing. Attorney Page fought against this dehumanizing cliche, interviewing all the young woman's neighbors and friends, obtaining compelling evidence that the young lady had proven priceless to her children, caring for them valiantly and providing irreplacable love and nurturing. The case was settled the first day of the trail for about $4.25 million, which Attorney Page structured so that the settlement had a $27 million dollar pay out over the children's life expectancy.

If you're impressed by Brenda L. Page's achievements, feel free to contact the Page and Associates Law Office, P.C. in Richmond, Virginia.

Zicam Cold Remedy Nose Spray Running Out of Excuses

Matrixx Initiatives, the manufacturer of Zicam Cold Remedy have stated that they will pay $12 million as a reaction to the 340 lawsuits piled against them, but refuse to admit the damages caused by the spray. According to the Washington Post, Matrixx said that the motion was "not an admission of liability, but rather an effort to end most of the litigation over the homeopathetic remedy."

Some 400 lawsuits total have been filed against Matrixx since 2003, including numerous victims of the defective product who claim to have lost their senses of smell and taste entirely. All of these victims claim that this loss was due to only one use of the product. Matrixx disregards this claim, blaiming the ansomia on some outside virus.

Matrixx still released a new "control tip sprayer", which would prevent the gel from being forcefully expelled into the nether regions of the nose where damage could be inflicted. Robert J. Murphy, the Matrixx spokesman, claimed that this new development was "a product advancement that has been in the works since 2001" and is "completely unrelated" to the litigation.

S. 852 Rejection Request from Asbestos Victims

More than 100 determined victims of asbestos exposure came to the U.S. Senate this week. Thier goal was to speak out against allowing companies responsible for asbestos related diseases including mesothelioma to walk away clean, as they are attempting to do with S. 852, a flawed bill that Senate is to debate this week. Because of this bill, many asbestos victims would die before compensation. It is therefore opposed by every major asbestos victims' organization. Interestingly, it is also opposed by taxpayer rights organization and some parts of the insurance industry.

One of one asbestos victims who visited the Senate, Charles Sales, suffered mesothelioma from his asbestos exposure. The asbestos bailout bill would obliterate his lawsuit against the responsible companies and force him to wait for a huge federal bureaucracy to form before he could receive any financial aid, leaving his young wife and two-year-old daughter with overwhelming medical bills and virtually no financial help.

A number of the law firms in this directory represent victims of asbestos exposure including mesothelioma victims. If you would like to learn more about your rights and how the Asbestos bailout bill might affect you, please contact one of the mesothelioma attorneys in this directory including the Law Offices of Peter Angelos, the Mesothelioma Lawyers Network.

Cochlear Implants May Increase Risk of Meningitis

The increased warning of meningitis concerning cochlear implants (the FDA first noted the connection in 2002) may mean that there is an increase of problems concerning the hearing devices. Cochlear implants are special devices that can allow deaf people to hear, through electric signals to the brain. The implants are especially stressed to importance in deaf children, who can then learn to master basic language skills at a young age. The meningitis risk that concerns the FDA has to do with a positioner the implant uses. The positioner increases the risk of a specific kind of meningitis, caused by the bacterium Streptococcus pneumoniae. Cochlear implants with a positioner were only manufactured by Advanced Bionics Corp.

If you or a loved one have been injured by a defective product such as a cochlear implant, contact the Meningitis Lawyers Network.

ADHD Drugs Favored for "Black Box" Warning

Ritalin and other drugs given to patients diagnosed with attention deficit hyperactivity disorder have been taken into consideration in a voting performed by the Food and Drug Administration advisory panel. The drug has led to the deaths of 19 children and 6 adults who had taken the drugs. It has been said that it would be "inappropriate, unethical behavior" to not disclose that there is a definite uncertainty concerning the ADHD drugs circulating among patients. The advisory panel has also recommended the inclusion of a medication guide with the drugs. While the FDA does not have to act on the advice of its advisory committees, it generally does, so expect some action concerning these harmful ADHD drugs in the future.

If a defective product has injured you or someone you know, try contacting Pomerantz, Perlberger, and Lewis of Philadelphia, Pennsylvania.

Stingy Insurance Companies

In an automobile accident in 2001, two-year-old Jakob Martin sustained head injuries that left him impaired so that he required full-time supervision and health care. The Martins' insurance company, Farm Bureau, agreed to pay $18 an hour or up to $324 a day for Jakob's care. All was well and good until the Martins placed their son in a special preschool for impaired children. Farm Bureau saw this as an opportunity to void their settlement with the Martins and stopped paying.

Jakob Martin had been placed in this preschool by his physician's suggestion, and with Farm Bureau's knowledge, for six months before the settlement deal was struck. The Martins had even tried to forego reimbursement for the three hours that Jakob was in preschool every day, but once Farm Bureau saw an opportunity to scuttle the settlement as a whole, they jumped on it.

If insurance companies don't want a bad reputation, why do they keep hurting people? We don't know how the Martins are going to pay for their son's to be taken care of full-time, now that the insurance company has pulled their financial rug out from underneath them. If you're feeling nervous about an insurance company or wish to seek professional guidance, contact a personal injury lawyer such as Marc Whitehead and Associates in Houston, Texas.

If you'd like to hear more of Jakob's story, read the press release concerning his accident.

Benzene and AML: Acute Myelogenous Leukemia

Although the exact cause of AML is unknown, it has been determined that environmental factors such as radiation and benzene are linked to the disease. Acute myelogenous leukemia has many other names, such as acute myeloblastic leukemia, acute myelocytic leukemia and acute nonlymphocytic leukemia. It is not contagious or inhereted; the disease develops when an immature cell in the bone marrow defects, so the body does not produce enough blood cells. Symptoms of AML include:

  • lack of clotting; free-bleeding
  • easy bruising
  • the occurence of small spots on the skin
  • more infections, i.e. more frequent sore throats
  • bone or joint pain
  • mild fever
If these symptoms appear in a person exposed to Benzene who is concerned about AML, a blood test may be administered.

If you have AML due to radiation or benzene, or are concerned about contracting the disease from environmental factors in your area, contact a personal injury lawyer such as Jacoby & Meyers of Los Angeles, California.
