Verdict Against Family Dollar Store Stands in Wage and Hour Lawsuit
The United States Supreme Court decided that they would not review a $35.6 million judgment against Family Dollar Stores, Inc. in a class action
wage and hour lawsuit. As a result, the 2008 U.S. Court of Appeals ruling will stand, awarding each of the 1,424 plaintiffs in the lawsuit approximately $29,000 in back pay.
The class action lawsuit claimed that Family Dollar Stores violated the U.S. Fair Labor Standards Act by forcing employees to work 60-70 hours a week without receiving overtime pay since they were technically considered "managers." However, much of their time at work was dedicated to non-managerial tasks such as mopping floors, unloading trucks, and stocking shelves.
A spokesperson for Family Dollar expressed the company's disappointment at the Supreme Court's decision, and they stand by their employment practices. Unfortunately, while the company will be forced to compensate employees for time worked, the ruling is unlikely to prevent them from committing similar wage and hour violations in the future.

I WORKED FOR FAMILY DOLLAR AS A MANAGER AND WAS FIRED WHEN I JOINED IN ON THE LAWSUIT ITS BEEN A LONG HAUL BUT JUSTICE HAS BEEN DONE
I also was a manager for Family Dollar. I was afraid to join the lawsuit, but hung onto the letter I had received inviting me to join the class action suit. I was fired right after Christmas in 2002and I immediately filled out the paperwork and joined the lawsuit. I am so glad that I didn't throw that letter.
It is my understanding that money will be awarded based on the number of hours that you worked and not divided among the 1424 plaintiffs
has anyone who is a plaintiff in this case received the release form that the lawyers office is supposed to be sending out to yet? It is my understanding that this release form will have the figures as to what you are actually going to get from the settlement.
my wife is in lawsuit lawayers are slow getting release out but class action every one should get equal cut
According to the first correspondence from the lawyers in October, which was due back by October 19,forms were to go out within two weeks. The telephone data line up-dated on November 3rd, 2009, said that the forms were to be sent out on or before November 15th 2009. My last conversation with the lawyer's office said the forms would be mailed on December 1, 2009. I guess we will see if this date is accurate.
I just called this morning and the recording says that because of issues and delays they are hoping to have the forms sent out in the next 2 weeks. It is suppose to include 3 forms, release form, attorney compensation to sign and a letter with amount that each will get. I was told last month that the amounts would be figured on the actual overtime, liquidated damages and interest. Hope this helps just waiting again after all these years.
Well again Family Dollar got the best of us. I got my letter today and I don't know where the news got the info but the offer is no where near the $29,000 mark. After taxes, lawyer fees, expenses it is going to average around 1% of the estimated amounts. Plus now we have another w2 for this year to claim! I thought there was liquidated damages? Not sure what that is but what I read said it doubled the amount. Oh we have to pay taxes on the interest, what little there was, too!!!

everything is in one lump sum. after taxes and lawyer fees we are not going to get much. all of the money is added together.

I received my settlement letter on Dec. 3. It was for 12800.00 before deductions. I ended upo getting 4805. In the disbursement schedule it showed less taxes on back pay, however when I got my w-2 from Family Dollar it was for 5798. with 2200 taken out in takes(the same amount on schedule). I then received a 1099-misc. from the attorneys and that included the back taxes as wages. Did anyone else have this happen? it looks like I got taxed twice
Well I just got notified yesterday that they has been looking for me for a long time ( moved from Florida) The lady told me that they had money to give me and she wouldnt tell me how much. Only a figure that was left for the 12 she was looking for. Today I got a notice from the USPS that I had 2 letters at the Post Office. I talked to a lawyer today that said that it would be divided out equally. Has anyone gotten their money recently. And did you get interest from the time of settlement to day you got your letters, cause an attorney told me that too. Also said be careful that we dont get ripped off. For who are we to know what anyone else gets and what the cost were for the attorneys. I am almost scared to get excited at this point.
