Officer Involved in Dog Attack in Georgia

A Georgia officer is recovering after being attacked and bitten by a dangerous dog. The female officer was attempting to pick up a dog and place it in her pickup truck when another dog attacked her and bit her on the lower leg.

While the dog bite did not leave severe injuries, it did leave two fairly large gashes in the woman's calf. After being bitten, the officer requested help from animal control and told them where they could find the dangerous animal. Once apprehended, the dog was taken to a local animal shelter.

After an animal has bitten someone in Georgia, it must be held for ten days following the biting incident so that it can be observed. During this time, the dog is kept away from humans and other animals to make sure it is not suffering from rabies or any other diseases.

Fortunately in this case, the officer did not suffer any serious injuries, but for other dog bite victims, the animal attack can lead to serious consequences. For small children especially, a dog bite can result in facial lacerations, severe cuts and bruises, or broken bones.

If you or a family member has been attacked and bitten by a dog, it is important to consult an experienced dog bite lawyer in your area. You may be eligible to receive compensation for your damages.

If you have a dog bite claim in the Atlanta, Georgia area, please contact Robbins & Associates, P.C. today to schedule a consultation.

Family receives $12 Million in Compensation for Birth Injury

A Rockford, Illinois family has recently received a $12 million settlement after filing a medical malpractice claim against the hospital staff that delivered their baby. The birth injury that occurred during the delivery of their son has caused him to develop cerebral palsy.

The hospital staff assumed that the baby was in the right position for the delivery, but they failed to verify the fetal position. In the end, the baby was positioned for a breech delivery. However, the hospital staff realized this too late to perform a Caesarean section quickly enough. The baby was deprived of oxygen for an extended period of time, leading to permanent brain damage.

The child now must be monitored 24 hours a day and he is kept on a ventilator. Because of the negligence of the hospital staff, the child suffered catastrophic injuries, preventing him from living a normal life. The settlement reached in court was awarded to the family so that the child can be cared for during the rest of his life.

Medical malpractice is a horrific event that can transform an entire family. Doctors and nursing staff that are negligent and fail to provide the care and expertise required need to be held accountable for their actions or negligence.

If you or a loved one has suffered injuries after medical malpractice, it is important that you consult a medical malpractice attorney as soon as possible. In addition to reviewing medical records and conducting interviews, a medical malpractice attorney will file your medical malpractice claim before the statute of limitations runs out on your claim.

If you have a medical malpractice claim in the Chicago, Illinois area, please contact the Law Offices of Barry G. Doyle, P.C. today to schedule a consultation.

Oregon City Fined for Asbestos Violations

The Oregon Occupational Safety and Health Administration (OSHA) has fined Central Point, a city located in Southern Oregon, for failing to protect workers from asbestos. During a demolition project performed by the city of Central Point, trace amounts of asbestos were found in the debris.

Asbestos is an incredibly dangerous substance that can cause serious health problems, including mesothelioma. The city should have told the employees working on the demolition that there was asbestos in the area. Some of the symptoms of mesothelioma include:

  • Chest Pain
  • Shortness of Breath
  • Viral Pneumonia
  • Persistent Cough

One of the problems with mesothelioma is that it can be hard to diagnose; often, it takes decades for the disease to develop.

Situations like this can happen all the time, and if your work has failed to inform you of the presence of asbestos, you may be able to recover compensation for any sickness that you develop as a result. An experienced asbestos injury attorney will work with your medical records and help you file a claim so that you can get compensation for medical bills, loss of work, and pain and suffering.

If you have an asbestos or mesothelioma claim in Maryland, Pennsylvania, or Delaware, please contact the Law Offices of Peter G. Angelos today to schedule a consultation.

Atlanta Officers Come Forward Against City Workers' Compensation System

Four officers in wheelchairs came forward in Atlanta last week to speak out against the city's workers' compensation system. According to the former police officers that were injured while on-duty, the city's workers' compensation program has been systematically challenging their medical needs for the past two years.

In addition to questioning the men's need for oxygen, the city has apparently also delayed crucial repairs to wheelchairs, cut off drugs to the officers, and delayed much-needed surgeries. The officers claim that the city is fighting their treatments because they are trying to save money.

When companies and local government agencies refuse to provide workers with the compensation they need after a work-related injury, it can seriously impact their ability to receive the medical care they require. An experienced workers' compensation lawyer will work for you so that you get the compensation you need for your medical expenses as well as for the pay you would have received if you hadn't been injured on the job.

If you have a workers' compensation claim in the Atlanta, Georgia area, please contact Robbins & Associates, P.C. today to schedule a consultation.

Drunk Driving Teen Kills Two Women in Boston

In yet another heartbreaking story, one woman's life was cut short and another was injured at the hands of an irresponsible teenager who chose to drink and then drive his car in Boston, Massachusetts.

The two women, mother and daughter, were walking their dog down the street when they were hit by a car. The car was being driven by an 18-year-old high school student who had gotten drunk at prom.

The pedestrian accident was so loud that neighbors thought the sound of the car accident was thunder or a loud motorcycle. When neighbors came outside to help the injured women, the teens attempted to flee the scene, but stayed after being called after.

Illinois Woman Seeks Compensation After Slip and Fall Accident

A woman in Illinois is suing a bar and restaurant after she fell and suffered serious, permanent injury to her knee. In addition to the knee injury, the woman incurred medical expenses and lost wages when she was unable to perform her job after the accident.

The woman claims that she was attempting to walk from the bar area of the restaurant to the patio when she slipped and fell on the floor of the restaurant. Just before she walked across the room, an employee was allowed to mop the floor, leaving it wet and slippery without appropriate warning to customers.

The lawsuit claims that the restaurant is responsible for allowing the employee to mop the floor in an area where customers could injure themselves. This lawsuit is an excellent example of how common slip and fall cases can be. From this seemingly small mistake of mopping the floor, a woman has now suffered a great deal of pain and economic losses.

Slip and fall accidents can be very serious. While this woman only injured her knee, in other slip and fall accidents, people can suffer neck injuries, brain injuries, and spine injuries.

If you have a slip and fall claim in the Chicago, Illinois area, please contact the Law Offices of Barry G. Doyle, P.C. today to schedule a consultation.

Defective Mercedes-Benz Cars Recalled

When you purchase a new Mercedes-Benz, you expect to be purchasing the best quality available in an automobile. For many California car buyers, this wasn't the case, causing Mercedes-Benz to issue a recall for more than 16,000 vehicles.

The product recall has been issued after an investigation into the cars revealed the seal around the taillights in these vehicles was faulty. The inadequate seal can allow water into the taillight control unit, causing it to short circuit. This has been known to result in a car fire.

Whether the defect is caused by poor design of the product, bad manufacturing, or incorrect assembling, if a defective product injures you or your family, you may be eligible to receive compensation for your damages. A defective product can be very dangerous, and a defective car could result in serious injuries to you and your loved ones.

In this case, the recalled cars may be covered by California's Lemon Law. This law allows car buyers who have attempted to correct their car's problems through the dealers to receive a new vehicle or get their defective vehicle bought back from them.

If you have a defective product claim in the Denver, Colorado area, please contact the Law Offices of Burg, Simpson, Eldredge, Hersh & Jardine, P.C. today to schedule a consultation.

Texas House Clears Workers' Compensation Bill

The Texas House of Representatives passed a bill that will potentially make it easier for independent contractors to receive workers' compensation from property owners if they are injured on the job.

The bill just barely passed by majority in the Texas House by a vote of 73-71, and it overturned a previous law that shielded property owners against lawsuits brought by contract workers. The workers' compensation bill will now be passed on to the Senate for approval so that it can be made a law.

In the past, property owners could not be sued for additional damages if a contract worker was seriously injured on the job as a result of their neglect. The new bill will change the law so that contract workers can recover the compensation they deserve.

Workers' compensation claims are complex and difficult to handle. If you are a contract worker that has suffered an injury on the job, an experienced workers' compensation attorney can help you receive the reimbursement you deserve.

Two Women File Medical Malpractice Lawsuit in Tucson, Arizona

On April 10, 2005, Christopher Lambeth, a mentally ill man, stabbed his two grandparents to death. The mother and aunt of Christopher Lambeth are now filing a medical malpractice claim in order to recover damages from the psychiatrist as well as the behavioral agency that worked with Christopher.

Prior to the killings, Lisa Lambeth told her son's psychiatrist that he had not been taking his medication and she requested he be taken to a mental facility. COPE Behavioral Services, Inc. claims that Lambeth was wholly or partially at fault for the killings.

Dr. Virgil Hancock had seen Christopher Lambeth numerous times in the presence of his mother and has even gone so far as to sign a note claiming Christopher Lambeth was "unable to control his anger, was homicidal, had a target, and a plan."

Just three days before the killings, Lisa Lambeth requested that COPE behavior services take Christopher out of her parent's home, but neither Dr. Hancock nor COPE Behavioral Services took any action.

If you or a loved one has suffered injuries or even wrongful death as a result of the negligence of a medical professional, you may be able to recover compensation for your losses. It is important to consult an experienced medical malpractice lawyer to ensure your rights are properly defended.

Victims and Surviving Family Members May Receive Workers' Compensation

Pittsburgh, Pennsylvania workers who worked from 1942 to 1944 in the Westinghouse Atomic Power Development Plant may be able to recover federal compensation if they suffered from certain forms of cancer. If they died from cancer caused by working in the plant, their surviving family members may be eligible to receive this compensation.

The compensation is a plan formulated by the U.S. Department of Labor to pay workers or their families for handling uranium in the plant. The National Institute of Occupational Safety and Health has determined that the workers in the plant during those years are part of a special group to receive up to $150,000 in a lump sum settlement.

In order to qualify for the lump sum compensation, surviving family members or workers would most likely have to provide some form of proof their work led to the formation of their cancer. This new compensation plan is part of a larger atomic workers' compensation program that has awarded over 48,000 workers with compensation for their workplace injuries.

If you or a loved one falls into this group of people, an experienced workers' compensation attorney can help you gather the proof you need to gain the compensation you deserve.

8-Year-Old Saves His Friend from Violent Dog Attack

An 8-year-old boy from Florida showed tremendous bravery last week when he rescued his best friend from a violent dog attack. Aaron Dingman was playing at his friend Lucas' house, when Lucas' dog lunged at Aaron, mauling his face.

The dog sliced Aaron's face open. When Aaron tried to punch the dog in self defense, it chewed at his thumb. Aaron's hand was torn open by the dog bite. After that, Lucas jumped in and helped his struggling friend, pulling the dog off of Aaron before he sustained any additional injuries. Had Lucas not intervened, the dog may have killed Aaron.

Aaron went to a local hospital to receive treatment for his injuries. He still has not been able to return to school yet. A plastic surgeon treated the lacerations on his face earlier this week, and Aaron has been recovering well.

Lucas' family has decided to put the dog down to prevent other violent attacks. It is uncertain whether Aaron's family will sue to receive compensation for medical expenses and emotional trauma caused by the dog attack.

Wal-Mart Settles with Nassau County DA in Black Friday Stampede

Wal-Mart reached an agreement with the Nassau County District Attorney in relation to incidents stemming from a stampede at one of their Long Island stores on Black Friday. Last November, shoppers looking to take advantage of early Christmas deals stormed the store, injuring several employees and shoppers in the process. One employee died in the stampede.

As part of the settlement, Wal-Mart avoids criminal prosecution over the death of their employee. It also ends the investigation that has been conducted by the District Attorney's Office since last November.

The agreement requires Wal-Mart to comply with the following provisions:

  • Develop a crowd management plan for post-Thanksgiving Day sales events at all 92 stores in the state, which will be approved and monitored by a third party safety team
  • Establish a $400,000 victim's compensation fund to repay expenses for victims -- expenses covered will include lost or damaged property, lost wages, and medical bills from injuries sustained
  • Provide a $1.5 million grant to Nassau County social services and nonprofit groups
  • Set aside 50 jobs to Nassau County teens at the county's five store locations for the next three years

Wal-Mart did not have to admit to any wrongdoing as part of the settlement. The District Attorney felt that this was a much better resolution to the case than prosecuting Wal-Mart on criminal charges. By law, a corporation cannot be sentenced to jail. The maximum fine they could have received for the incident was $10,000. By cutting this deal with Wal-Mart, the DA was able to force the company to make sweeping changes to its safety policies that will hopefully benefit all 92 stores in the state.

If Wal-Mart fails to comply with any portion of this agreement in the next three years, the District Attorney's Office has the right to reopen the investigation and resume criminal prosecution.

Injured victims still have the option of not accepting compensation through the established fund and instead filing a premises liability lawsuit against Wal-Mart. However, by opting out of the settlement plan, injured victims risk not receiving any compensation at all. The corporation also still faces a wrongful death lawsuit from the family of the employee who died in the incident.

2 NY Brain Surgeons Suspended for Abandoning Patient in OR

Two of New York's highest paid brain surgeons have recently been suspended for two weeks after abandoning a patient in the operating room. The patient had already been anesthetized and prepped for her brain surgery.

The two surgeons involved in the incident were Thomas Milhorat, chief of neurosurgery at North Shore University Hospital, and Paolo Bolognese, a colleague of Milhorat's.

The suspensions were given out following an incident on April 10. Bolognese had a patient in the operating room. Her head had been shaved and she had already received anesthesia, but Bolognese was nowhere to be found. Hospital staff called on Milhorat to perform the surgery, but he refused because she was not his patient.

Since there were no other surgeons available at the time, the surgery was never performed. The incident is currently under investigation.

Milhorat and Bolognese run North Shore University Hospital's Chiari Institute, a facility that treats patients suffering from a rare congenital brain injury causing headaches, dizziness, and other symptoms.

This is not the first time the two surgeons have had complaints filed against them. Both doctors are currently facing three medical malpractice lawsuits for improper conduct. One lawsuit alleges that they used patients with the brain defect, including a 4-year-old, as guinea pigs for research and financial profit.

Another lawsuit alleges that the doctors told the parents of a 12-year-old girl that her surgery would be a "walk in the park." However, since her surgery, her condition has continued to steadily decline.

Doctors have a responsibility to do everything in their power to provide their patients with the best care possible. The actions of these two doctors failed to live up to this responsibility and constitute a major surgical error. If you have been the victim of a surgical error, it is important to consult an experienced medical malpractice lawyer. You may be entitled to receive compensation for your damages.

If you have a medical malpractice claim in the New York City area, please contact the Law Offices of Silberstein, Awad & Miklos, P.C. today to schedule a consultation.

2 Dogs Get Loose, Attack People at Missouri Mall

Two pit bulls got loose in the parking lot of a Columbia, Missouri shopping mall and attacked several people nearby. Police have confirmed one dog bite victim. He was attacked when he tried to divert the attention of the dogs while they were chasing a woman in the parking lot. Police are expecting to hear reports of other victims shortly.

Police officers shot and killed one of the pit bulls at the time of the attacks. The other dog escaped and is still on the loose. The dogs' owner was arrested and charged with assault and obstructing police operations.

The dog on the loose is a gray pit bull with a white chest. He is believed to be heading towards his trailer park home in Columbia. Police have ordered the dog's owner to notify them immediately if the dog shows up so that they can have it evaluated by animal control.

Dog owners have an obligation to take the proper measures to ensure that their dogs do not attack innocent people they come into contact with. This obligation is heightened when a dog has demonstrated a history of violence or is a breed known for dog bite attacks, such as a pit bull. When dog owners fail to take the proper precautions with their pets, they are guilty of negligence and can be held liable for damages sustained in the dog bite attack.

If you have been the victim of a dog bite attack in the Chicago, Illinois area, please contact the Law Offices of Barry G. Doyle, P.C. today to schedule a consultation.

Child Severely Injured in Hyperbaric Chamber Explosion

Recently, an Italian family flew to the United States in hopes that they could receive treatment for their young son, Francesco. Their hometown raised over $100,000 to send Francesco and his family overseas to receive treatment for cerebral palsy, a birth injury that has prevented him from walking and talking properly.

Francesco traveled to South Florida so that he can receive hyperbaric oxygen therapy. During the session, Francesco's grandmother lay in the hyperbaric chamber holding him so that he would feel safe. While they were in the chamber, there was an explosion and flash fire that burned both Francesco and his grandmother. Francesco suffered severe burn injuries over 90% of his body, and his grandmother died in the accident.

Doctors are currently uncertain whether Francesco will survive the accident. He is still in critical condition.

This is the first time there has been a fatal hyperbaric chamber explosion in the United States. Investigators are looking into the cause of the accident.

It is important to consult an experienced wrongful death attorney if you have a loved one who has died due to the negligence of another. You may be entitled to receive compensation for your damages.

Laci Peterson's Family Drops Wrongful Death Suit Against Her Husband

Laci Peterson's family has dropped their wrongful death lawsuit against her former husband Scott Peterson. He is currently on death row for the murder of Laci and their unborn son.

Laci's mother and stepfather withdrew the lawsuit in a Modesto, California court last week. The trial would have begun next month. Scott Peterson was convicted of both murders in 2004 and was sentenced to death in 2005. He is currently on death row at San Quentin State Prison in California. His lawyers have appealed his conviction to the state Supreme Court.

It is uncertain why Laci Peterson's family has decided to drop their wrongful death lawsuit against her former husband. As of yet, they have not released a statement regarding their decision.

It is possible for a person who is convicted of murder to also face a wrongful death lawsuit in a civil court. If a person's actions against another lead to the victim's death and the actions were committed with an intention to inflict harm, the murderer is also guilty of wrongful death.

The murder case will result in criminal charges and consequences such as jail time, or in some cases, the death penalty. The wrongful death lawsuit, which must be filed by a member of the victim's immediate family, will provide the victim's family with financial compensation for their loss.

If you have a wrongful death claim in the Phoenix, Arizona area, please contact the Law Offices of Snyder & Wenner, P.C. today to schedule a consultation.
